In the Board’s Proceedings cited, orders have been issued revising the procedure in sanction of pensionary benefits to the employees of the Board retiring on or after 01.04.2003. Various Unions have filed Writ Petitions against these orders. The Writ Petitions were finally heard by the Division Bench of the High Court, Chennai. The Division Bench delivered Judgment upholding the orders issued in (Per.) B.P. (Ch.) No.64, dated 31.03.2003 relating to qualifying service for Pension and calculation of Pension, (Per.) B.P. (Ch.) No.66 (SB), dated 31.03.2003 relating to revised limit of communication and quashing the orders issued in (Per.) B.P. (Ch.) No.65 (SB), dated 31.03.2003.
2. All the Pension Sanctioning Authorities are, therefore, instructed to settle the pensionary benefits namely Pension, Death Cum Retirement Gratuity and Commutation of Pension in respect of persons retiring on or after 31.10.2003 based on the orders issued in (Per.) B.P. (Ch.) No.64 (SB), dated 31.03.2003 and (Per.) B.P. (Ch.) No.66 (SB), dated 31.03.2003 consequent on the judgment of the Division Bench of the High Court, referred to above. It may be specified in the order that the sanction of commutation amount is without prejudice to the appeal if any to be filed.
